A weed is a plant in a place you don’t want it. Given that you’re asking if you can get rid of it, I’d say the answer is yes, it’s a weed
The waxy leaves are interesting, makes me think of magnolia leaves.
I would say it’s a magnolia. I would also say you do not want a magnolia growing into the foundation of your house

I’m gonna agree with the consensus that this is a magnolia and you should remove it ASAP because the roots of these things will destroy your foundation

Any unwanted plant that you didn’t plant is a weed, even that magnolia.
