Either way I wouldn’t want a transplant that close to the fence. I would take it out.

This looks like (invasive) Chinese Pistache, easily confused with native Western Soapberry. Take off a leaf and crush it in your fist, then smell. If you can smell it, it is Chinese pistache. If you smell grass or not much, it is a soapberry.
