Looks like a self seeded privet. Cut it at the base and paste the remaining trunk with poison instantly.

Privet. Destroy with prejudice. Potential damage to your home aside, these things are environmental weeds. They produce thousands upon thousands of seeds every year which spreads them even further.
The only good privet is a dead privet.
You have a choice. Remove the tree or remove the wall. My advice would be the former.
Cut off as near to the base as possible and IMMEDIATELY paint the stump with neat glyphosate. Problem solved.
