Can you show what the leaves currently on the tree look like? Can you show us the tree itself?

Not an arborist, but the black spots might be tar spots—a surface fungus. It usually doesn’t kill the tree, but will make a tree look unhealthy. I was told to rake and bag a leaves that fall so the spores don’t reinfect fresh leaves
