Is the tree on your property? Based on the fence I am guessing not. If you remove the root and it kills the tree then you could be held responsible and that can get expensive.

If the root is less than 3″in diameter you should be fine. Any more than 3″ you should consult a licensed arborist. You still may be able to cut it if it’s bigger but only with the green light from a professional.
