SMITH COUNTY, Texas (KLTV) — One person is in jail following a shooting on Montgomery Gardens, northeast of Tyler.

It happened this afternoon on montgomery gardens in the 2200 block, that’s off highway 271.

Smith County Sheriff’s Deputies, and also a state trooper were already nearby and arrived within about a minute.

“We received a call of shots being fired in the area of montgomery gardens,” says Smith County Sheriff’s Office spokesman Sargeant Larry Christian.

When they got there, they quickly detained two people while they figured out what happened.

“A female and a male pulled up in front of a residence….and a male came out of this particular residence with a rifle and got into an argument with a female during the course of that argument,” says Christian.

Christian says another man who was there wasn’t involved in the argument and tried to distance himself.

He got back into the passenger seat of a black car, and that’s when several shots were fired at the vehicle.

The passenger door of the black car took most of the gunfire, with two flat tires in the front.

“By the grace of God, nobody got hit,” says Sargeant Larry Christian. “I mean, this is very, very fortunate that we didn’t have anybody shot as a result of this, but we do have the male who did the shooting.”

The sheriff’s office says the suspect came out of this yellow house.

Deputies also checked nearby homes and businesses to make sure no one was hit by stray bullets.

“When you indiscriminately shoot a gun or even shoot it towards something that you know, a known target, you know, those bullets, they basically have a mind of their own and they can go anywhere,” says Sargeant Larry Christian.

Christian says the man faces a charge of aggravated assault with a deadly weapon.
