Before you start trimming and chopping back your garden for spring, there’s an important question to consider: Can you cut a neighbour’s tree if it overhangs your garden?
We’ve all had to tackle long branches spilling over our fences, but cutting back what isn’t yours could land you in a tricky situation — or even with a hefty fine.
‘You have the right to trim branches that cross your property line, but only up to the boundary,’ say the team at Yell. ‘If there are overhanging branches on your side of the fence or wall, you can cut them back, but you should let the neighbour know and return the branches that you’ve cut off.’
According to the RHS, trees on boundary lines are owned jointly by both neighbours. Cutting off overhanging branches is classified as ‘abating a nuisance’ and does not require permission. For example, unruly branches that interfere with the enjoyment of your garden may be considered a nuisance under common law.
‘Only in situations where you need access to their land to undertake the work would permission be required,’ say the RHS. If you are unsure, check with your neighbour or visit the Land Registry Online to view your boundary lines.

It’s also worth noting that some trees are protected by Tree Preservation Orders (TPOs) to maintain their environmental and aesthetic value. If you cut down a protected tree, it could lead to fines of up to £20,000.
‘In severe cases, unlimited fines can be granted. Before undertaking any work, such as cutting down or topping, it’s worth checking if they are protected with a TPO,’ says the team at Yell. You can do this by checking with your district or borough council’s planning department or tree officer.
