
We've been in this current house for less than a year, but we're looking at turning our attention towards these labernum trees. When we moved in last spring, they looked amazing, but my understanding is that every aspect of them is poisonous. The one on the right isn't in a great state, and looks a bit hacked, so we were considering taking it down and replacing it with a smaller fruit tree (they do block a bit of light). I'm not fused by getting all of the stump and roots out, but would it be OK to plant a different tree pretty much in the same spot? Is there anything we need to consider whilst doing this?

You will struggle to plant near those trees even when they’re cut down. The root systems on them will be substantial! If it has to be there then plant in the middle between the 2 and expect to use at least a mattock if not a breaker bar while digging.
I understand that you’re concerned about the trees being poisonous, is that because of pets or children? If not I would suggest a hard prune of those trees and planting of a fruit tree anywhere else.
Seems bonkers to me to put a fruit tree in where the right hand one is. It’s in the shade and critical rootzone of another more established tree and will not thrive. I’d remove the right one as it’s structurally poor and put in a nicer tree/shrub but wouldn’t put a fruit tree there as you’d be handicapping it.
