The Nagpur Bench of the Bombay High Court has cleared the way for the development of a garden at Sonegaon by dismissing a petition related to ownership claims over a plot of land in Mamta Cooperative Housing Society. The ruling was delivered by Justice Prafulla Khubalkar.
The petition was filed by Ganpat Talkhande, who claimed ownership of the disputed plot and had fenced the land and installed a gate. However, the Nagpur Improvement Trust (NIT) maintained that the plot was reserved as open space. Acting on this, NIT issued a notice on November 22, 2025, directing the removal of the alleged encroachment, including the gate and fencing.
Challenging the notice, Talkhande first approached the district court seeking a status quo order. The district court rejected his plea on December 9, after which he moved the High Court.
Appearing for NIT, advocate Girish Kunte submitted several documentary records and argued that the petition lacked merit. After examining the material on record, the High Court accepted the submissions and dismissed the petition, thereby paving the way for the proposed garden’s development.
