Ahead of the construction of a third Garden Terrace building, New Ulm City Council approves new easements for the property.

NEW ULM – In preparation for the construction of a new Garden Terrace building, the New Ulm City Council approved a vacation of a current city easement on the property.

Last month, the council approved a preliminary plat for Garden Terrace Second Addition, allowing Rebound Real Estate to construct a new 39-unit, three-story apartment building on a vacant lot near the two existing Garden Terrace buildings. Upon completion of the new building, Rebound plans to lease the building to Oak Hills Living Center, which operates a senior living facility on an adjacent property.

During the platting for the first Garden Terrace Addition in 1993, a five-foot easements were dedicated to the property. Portions of the new Garden Terrace building will cross portions of the easement areas.

Rebound Real Estate president Jay Scott requested the city vacate the existing easement areas to allow the construction.

New easements areas will be built into the new plat that accommodate a third Garden Terrace. The new propose easement would a be expanded to 10 feet in width and would surround the entire Garden Terrace block.

In addition a large section of the lot near Garden Terrace’s 10th N. Street entrance would be placed in an easement. This will allow for the creation of stormwater retention pond.

Community Development Director David Schnobrich said staff recommended approval of the easement vacation to allow the new construction and the replacement easement would be adequate for the property.

Schnobrich added that the new easement areas would not be in location to serve all utilities. He said it might be necessary to prepare a separate easement document for electrical and other utilities. He said staff is still making a determination if additional easement documents will be needed.

Councilor Tom Schmitz made the motion to approve the easement vacation request

“I think this is a great residential development in Ward-Three and will benefit our community immensely,” Schmitz said.

The motion was seconded by Councilor David Christian and was unanimously approved by the council.
