We purchased our home last October in a new development and noticed drainage issues on this side of our home. The neighbor’s lot is slightly higher so it slopes down toward our house.

We had the builder come by twice regarding this issue and they said “it’s just the sprinkler system.” Basically our neighbor’s sprinkler system drains into our yard. They also didn’t install gutters, but I don’t know what the city requirements are where I live (I know WA state requires them, but city can vary). Been trying to get my hands on the CDs to see if gutters were included, but no one wants to get back to me.

Anyway, we have a sinkhole forming now. The area always looks like this and I’m tired of the builders brushing it off as nothing. We are still under warranty, so I’m thinking it might be worth fighting to get fixed?

    You need to review the builders contract and see what “finished” means. Do they need to finish with grass?

    Surely I would at a minimum tell them the concrete washout needs to get cleaned up and the ground needs to be finished with clean topsoil and not whatever this stuff is.

    That said, they can’t really fix drainage coming from your neighbors yard.

    First, go ask your neighbor if they can change the spray of their sprinklers. Most places don’t allow neighbors to drain water from their property onto another’s. They may not know it’s causing you issues.

    Second, no ground cover? Having grass might be enough to solve the problem.

    Where does water from your property drain to otherwise? If you still have issues after talking to the neighbor and getting some plants in, then you may be able to get the builder to add drainage (French drain, trench, regrading, etc).
